Despite state and federal laws prohibiting sexual harassment in the American workplace, sexual harassment continues to be pervasive, costing American businesses about $1 billion annually in absenteeism, low morale and new employee training and replacement costs, according to the U.S. Department of Labor. This figure does not even include litigation fees and judgments in civil court cases, which often exceed $250,000 per case.
Multiple studies have shown that 40 70% of all women, and 10 20% of all men, experience sexual harassment in the workplace at some point in their careers. In FY2002 alone, 14,396 claims of sexual harassment in the workplace were reported to the Equal Employment Opportunity Commission (EEOC) compared to 10,532 in 1992an increase of 37%. Of the sexual harassment claims reported to the EEOC in FY2002, 14.9% were filed by men, compared to 9.1% in 1992.
While these figures may seem small when compared with the number of employees in the American workforce, it is estimated that approximately 90% of sexual harassment incidents in the workplace are unreported. These incidents occur among all levels of management and non-management, and in organizations of all types and sizes. According to the American Management Association, 27% of Fortune 500 companies have encountered sexual harassment claims stemming from employee misuse and abuse of corporate e-mail and internet systems.
